Got a response from Oscar Gomez, supervising regional planner of the county's zoning enforcement office, who updates us on what's going on next week with Sahag Mesrob Armenian Christian School:
The school filed an appeal to the Final Notice pursuant to Section 22.60.390 of the Los Angeles County Zoning Code. Section 22.60.390 of the Zoning Code provides that any person in receipt of a Final Notice may file an appeal to the Final Notice of Violation. Their appeal is scheduled to be considered by a Hearing Officer on December 2, 2008. This is not a public hearing.
The school is only appealing the Final Notice; THE SCHOOL IS NOT APPEALING THE CONDITIONAL USE PERMIT; THE SCHOOL IS NOT APPEALING THE CLEAN HANDS WAIVER.
The appeal process provides persons with due process and opportunity to be heard when challenging the noncompliance fee as provided by the Final Notice of Violation.
If the Hearing Officer denies their appeal and sustains the Final Notice of Violation, the Department will assess a noncompliance fee. Additionally, we will continue to purse further enforcement action, including referring the case to County Counsel for consideration of legal action against the school.
